Even worse is that her (its?) people took over the ship after dehydrating most of the crew into dodecahedrons of salts. They even crushed one dodecahedron just to prove a point. And he still slept with her. Scotty was the one actually doing something helpful (getting the aliens drunk.) Kirk did help a little bit by showing the aliens love, but he could've done more if he kept it in his pants.
You know Kirk would've banged that floating energy cloud if Zephyryn Cochrane wasn't married to it (maybe even then if the cloud wasn't so hostile...)

I think TNG had a bit of that as well. Regardless, those rules may refer to chain of command rather than rank and may only apply to direct subordinates. Thus it would be inappropriate for Picard to have a relationship with any officer or enlisted personal on his ship but there's nothing wrong with Geordi getting it on with an ensign from the science department. There may be a lot of unwritten rules surrounding it as well.

Kirk isn't the posterchild of Anything that Moves for nothing.
Kirk was trying to manipulate tenticle woman as part of the plan to get the ship back. He just picked the method that suits him best.
TNG seemed rather open-minded about crew relationships. Picard and Nella Daren didn't seem to be much of a problem and was accepted by the most of the crew, and she was a Lieutenant Commander and Stellar Sciences head. Low success rate, but not unusual.
It was just Janeway that had a problem with it, most likely more of a personal view.

Why do pepole feel the need to push the "gay issue" iam for one sick of hearing about gays, if thats what you do behind your own doors fine, dont bring it up when it has no bearing here, really. STAR TREK IS ABOUT EXPLORATION NOT HOMOSEXUALITY.

No-one's 'pushing' anything, Kirk/Spock merely happens to be a popular subject.
A big part of Trek is giving moral messages, promoting a better way of thinking. Exploring is seondary and minor. The lack of gay in Trek is why it's relevent to Trek.
