What copyright issues? who even cares, no one can do anything, just release it and try to ask who ever owns the models in the mean time. If that even matters to you

Because the mod could not be hosted anywhere, and it is steeling?
It doesn't matter if someone releases a model for free, it still belongs to them and if you want to re release it, you need their permission. These are real people, and some of them will go to the ends of the earth to get back at you for releasing their models without permission. In most cases though, they are nice guys and it is just wrong to take their work without asking.
Some times it is acceptable to release a mod with work while waiting for permission, but that is only for situations when the modder is no longer around, and hasn't been for years. Even then, it is generally frowned upon.

Legally not true, unless they have actually paid to copyright what they have created there is very little that can be done. Especially with a community that spans the globe, what is copyrighted in one country is not in another. Plus copyright is not forever they become part of the "global domain" when it runs out.
However it is common courtesy to seek and obtain the permission.

Oh sure, I don't think you can really say its 'illegal' but it breaks the rules of basically any prominent mod hosting website, and members such as myself wouldn't allow it. Sure, there's no legal action people could take against issues like this, but getting banned, or having the mod removed is not a legal action. Besides, who wants to do something against a talented author's wishes? It only creates more bad blood in this already dying community.

You are confusing a trademark and copyright.
In most countries, copyright is attached automatically when the creation is created. No forms, no paying. That copyright gives the creator the right to stop you from distributing their creation. Copyright applies around the world, there's even been international agreements on protecting copyright (nearly all countries are signed up to these).
In this example, it would be hard to host the mod. Any website (including file hosters/lockers) that follows US law would be vulnerable to DMCA takedowns. That covers a2files immediately. Fleetops.net probably wouldn't want to wade into any drama for no good reason, so it wouldn't be here. Majestic is a modder himself, so good luck getting it on MSFC without him vapourising you.
A trademark has to be applied for, and is more powerful and annoying. It has to be pretty unique, like the mcdonalds logo for example.

Still now word from Fahres and the creator of the Excalibur. Perhaps im gonna start extracting stand-alone ships from the mod next week so I can release them.
Ironically here is a beauty shot from the Excalibur in the "Azure Nebula" Map created by me.

Fahres always seemed like a reasonable chap to me. He let me use and kitbash his conny, and liked my Davids Class FF enough to want to release it himself 
Basically, i'd go ahead an release it and if anyone causes a fuss, deal with it then. Little sense worrying about something that hasn't (and may never) happen

Hey Guys,
Just wondering if this mod has stalled or just waiting for approvals still. If you cant get all the approvals you are seeking, will you release the mod with the material you do have approval for, just seems disappointing that a lack of a couple of approvals would wreck the release of the mod with material that does have approval.

I'm gonna release the ships I got permission for seperately, including some of the gfx changes required to use them. I can't say when, but it will happen

i really don't get why you don't release it anyway without permission :/ unless someone has specifically said don't use my model I don't see an issue... If they haven't replied to an email or said email no longer works then they obviously don't give a toss so just release it...
I could point you to a final fantasy VII mod where someone has included someone else's work in his mod and in the forum has said you can't use it and do you know what difference it made... none...
Once something is on the web it is pretty hard to protect, especially if it is mod related... do you honestly think any of these people can sue you for anything if they didn't agree? Need to change that last bit... Yes they do contain copyright but the onus is on the creator to sue you and carry all legal costs associated with it, do you honestly think any of us can afford that? do you know how hard it is and how much it cost to get a take down order? Why do you think they are only used by massive companies?

It's primarily a matter of courtesy, of respecting the wishes of others. It may be inconvenient, but it is the right thing to do.

only if someone has said don't use my model... If you can't get a response from someone you aren't providing a courtesy to them, just assuming one that doesn't exist. so if you are so caught up on being respectful you should only exchange refused models... Hell some of the models i could make for you if you want them that bad including the Excalibur as it's design is pretty basic

Exactly. I know how much time and effort it takes to create and/or edit new models especially for Armada 2.
I would never release anything without permission. It can be frustrating but you have to respect the original creators.
